4. Information about Goods

1. The Seller takes reasonable care to ensure that information concerning Goods displayed in the Online Store is accurate, complete and up to date.

2. Product pages may contain, depending on the type of Goods:

  • product name,
  • product identifier or SKU,
  • available sizes or capacities,
  • technical specifications,
  • intended use,
  • applicable standards and approvals,
  • product safety information,
  • manufacturer information,
  • Safety Data Sheets,
  • other technical documentation.

3. Customers should read the product label, instructions for use, safety information and technical documentation before using the Goods.

4. When purchasing engine oils, transmission fluids or other technical fluids, Customers should verify the requirements specified by the manufacturer of the vehicle, engine, gearbox or other equipment.

5. Any oil selector, recommendation tool or similar functionality made available through the Store is intended as an aid only. The final selection of a product should always be verified against the specifications and requirements of the relevant vehicle or equipment manufacturer.

6. Goods classified as hazardous substances or mixtures are offered, labelled, packaged and delivered in accordance with applicable product safety, chemical and transport legislation.

5. Prices

1. Prices displayed to Consumers in the Online Store are gross prices and include VAT applicable to the relevant transaction, unless clearly stated otherwise and permitted by law.

2. Prices are generally displayed in euros (EUR).

3. Delivery costs are not included in the product price unless expressly stated otherwise.

4. Before placing an order, the Customer is informed of the total amount payable, including:

  • the price of the Goods,
  • applicable VAT,
  • delivery charges,
  • any other applicable charges.

5. Where the Seller announces a price reduction, information about the previous price will be displayed in accordance with applicable EU and national consumer protection legislation.

6. Where required by applicable pricing legislation, the Store will also display the relevant unit price, for example the price per litre.

7. The final price payable is displayed before the Customer places the order.

6. Placing orders

1. Orders may be placed through the Online Store 24 hours a day, 7 days a week.

2. To place an order, the Customer:

  • selects the Goods and the appropriate product variant,
  • adds the Goods to the shopping cart,
  • provides the information required to process the order,
  • provides the delivery address,
  • selects the available delivery method,
  • selects the available payment method,
  • reviews the order summary,
  • accepts these Terms and Conditions,
  • places the order using a button or function clearly indicating that the order entails an obligation to pay.

3. Before placing the order, the Customer may review and correct the information entered.

4. Placing an order constitutes an offer by the Customer to conclude a Sales Contract with the Seller.

5. After receiving the order, the Seller sends an e-mail acknowledging its receipt. An acknowledgement of receipt does not, by itself, constitute acceptance of the order, unless it expressly confirms the Seller’s acceptance.

6. The Sales Contract is concluded when the Seller sends the Customer an e-mail expressly confirming acceptance of the order. Payment authorisation or collection alone does not constitute acceptance of the order.

7. The Seller provides confirmation of the concluded Sales Contract on a durable medium, such as the text of an e-mail or an attached document. The confirmation includes the contractual information required by law, the version of these Terms and Conditions applicable to the order, information about the right of withdrawal and the model withdrawal form.

8. Before accepting the order, the Seller may decline it if the Goods are unavailable, delivery to the requested destination cannot be provided, legal or transport restrictions prevent fulfilment, an obvious technical or pricing error has occurred, payment has not been authorised, or there are reasonable grounds to suspect fraud. The Customer will be informed without undue delay.

9. If an order is declined before the Sales Contract is concluded, any payment received will be refunded without undue delay and any payment authorisation will be released where applicable. After the Sales Contract has been concluded, the Seller may cancel or terminate it only on a valid legal basis or by agreement with the Customer. A refund does not exclude any other rights the Customer may have under applicable law.

7. Payments

1. Payments for orders are made online through Stripe.

2. The payment methods available to a particular Customer are displayed during checkout.

3. Available payment methods may vary depending on:

  • the Customer’s country,
  • transaction currency,
  • order value,
  • payment method availability,
  • Stripe configuration.

4. Payment processing may require additional authentication in accordance with applicable payment regulations and the requirements of the Customer’s bank or payment provider.

5. The Seller does not charge Consumers additional fees solely for the use of consumer debit or credit cards where such charges are prohibited by applicable law.

6. Payment card details may be processed directly by Stripe. The Seller does not need to receive or store the Customer’s full payment card number.

8. Delivery

1. Goods are delivered by courier using FedEx International services.

2. Delivery is available only to European Union Member States made available during checkout.

3. The exact delivery cost is displayed before the Customer places the order.

4. Orders are normally prepared for dispatch within 1 to 2 Business Days after successful payment confirmation.

5. Estimated courier delivery time is generally 2 to 5 Business Days from dispatch, depending on the destination country.

6. The delivery times stated above are estimates. Public holidays, transport disruptions or other circumstances may affect delivery, but do not remove the Seller’s obligations or the Consumer’s statutory rights in the event of delay.

7. Information such as “Dispatch in 24-48 h” refers to the estimated time required to prepare the order and hand it over to the courier. It does not constitute a guaranteed delivery time to the Customer.

8. Goods are delivered to the address provided by the Customer during checkout.

9. Certain Goods may be subject to special transport requirements due to their chemical composition or classification.

10. Where transport regulations prevent delivery of particular Goods to a certain destination, the Seller may limit or refuse such delivery and will inform the Customer accordingly.

11. Where payment has already been made for Goods that cannot lawfully be delivered, the relevant amount will be refunded.

12. Unless a different delivery deadline has been expressly agreed with the Customer, the Seller will deliver the Goods without undue delay and no later than 30 calendar days after the Sales Contract is concluded.

13. If the Seller fails to deliver within the agreed deadline or the statutory deadline, the Consumer may require delivery within an additional period appropriate to the circumstances. If delivery does not take place within that additional period, the Consumer may terminate the Sales Contract. An additional period is not required where the Seller refuses to deliver or timely delivery was essential in the circumstances recognised by applicable law. Following termination, the Seller will refund the payments received without undue delay.

14. For Consumer purchases, the risk of loss of or damage to the Goods passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the Goods. The statutory exception applies where the Consumer independently commissions a carrier that was not offered by the Seller.

9. Consumer right of withdrawal

1. A Consumer who concludes a distance Sales Contract has the right to withdraw from that contract without giving any reason within 14 days.

2. For Goods, the withdrawal period expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, acquires physical possession of the Goods.

3. Where one order includes several Goods delivered separately, the period begins when the Consumer receives the last item, lot or piece.

4. To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by means of an unequivocal statement.

5. The statement may be sent:

by post to:

VENOL MOTOR OIL Sp. z o.o.
ul. Lodowa 107
93-232 Łódź
Poland

or by e-mail to:

info@amgoil.eu

6. The Consumer may use the model withdrawal form set out in Appendix 1 to these Terms and Conditions, but its use is not mandatory. Any unequivocal statement communicating the decision to withdraw is sufficient. The model form is also provided with confirmation of the Sales Contract on a durable medium.

7. It is sufficient for the Consumer to send the withdrawal notice before the withdrawal period expires.

10. Consequences of withdrawal

1. If a Consumer validly withdraws from the Sales Contract, the Seller will reimburse all payments received from the Consumer in relation to that contract, including the cost of the least expensive standard delivery method offered by the Seller.

2. If the Consumer selected a delivery method more expensive than the least expensive standard delivery method offered by the Seller, the Seller is not required to reimburse the additional delivery cost.

3. The refund will be made without undue delay and no later than 14 days from the date on which the Seller is informed of the Consumer’s decision to withdraw.

4. Unless the Seller has offered to collect the Goods, the Seller may withhold reimbursement until it receives the returned Goods or the Consumer provides evidence of having sent them back, whichever occurs first.

5. The refund will normally be made using the same payment method used for the original transaction unless the Consumer expressly agrees otherwise and does not incur any additional costs as a result.

6. The Consumer must send the Goods back or hand them over without undue delay and no later than 14 days after informing the Seller of the withdrawal. The deadline is met if the Consumer sends the Goods before that period expires.

Goods should be returned to:

VENOL MOTOR OIL Sp. z o.o.
ul. Lodowa 107
93-232 Łódź
Poland

The Consumer may contact info@amgoil.eu for assistance with return arrangements. Prior approval from the Seller is not required to exercise the statutory right of withdrawal.

7. The Consumer bears the direct cost of returning the Goods unless the Seller has agreed to bear that cost or has failed to inform the Consumer of this obligation before the Sales Contract was concluded.

8. The Consumer must ensure that returned Goods are properly secured and packaged for transport.

9. Returned Goods must be transported in compliance with applicable safety and transport requirements. If particular Goods require special return arrangements, the Seller will provide appropriate instructions. For Goods that, by their nature, cannot normally be returned by post, the return cost or a reasonable estimate will be disclosed before the Customer places the order. These requirements do not, by themselves, exclude the statutory right of withdrawal.

10. The Consumer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods.

11. An exception to the right of withdrawal applies only where the relevant statutory conditions are met. Where required by law, the Consumer will be informed of the applicable exception before placing the order. Opening packaging or breaking a factory seal does not, by itself, remove the right to withdraw. Handling or using the Goods beyond what is necessary to establish their nature, characteristics and functioning may result in liability for diminished value under paragraph 10.

11. Complaints and conformity of Goods

1. The Seller is responsible for supplying Goods that conform to the Sales Contract and meet the requirements imposed by applicable consumer law.

2. Under Polish law, the Seller is liable for a lack of conformity existing at delivery and becoming apparent within two years after delivery, or within a longer period where required by law. Consumers retain any additional protection granted by mandatory provisions applicable in their country of habitual residence.

3. In the event of a lack of conformity, the Consumer may request repair or replacement. The Seller may provide the alternative remedy, or refuse both remedies, only where the conditions laid down by applicable law are met, including impossibility or disproportionate costs.

4. Repair or replacement will be carried out free of charge, within a reasonable time and without significant inconvenience to the Consumer. The Seller bears the necessary costs, including postage, transport, labour and materials, and will arrange collection where required by law.

5. The Consumer may request an appropriate price reduction or terminate the Sales Contract where the statutory conditions are met, including where the Seller refuses or fails to bring the Goods into conformity, the lack of conformity persists, or it is sufficiently serious to justify an immediate price reduction or termination. Termination is not available for a merely minor lack of conformity where applicable law excludes it.

6. Complaints may be submitted by e-mail to info@amgoil.eu or by post to:

VENOL MOTOR OIL Sp. z o.o.
ul. Lodowa 107
93-232 Łódź
Poland

7. To help identify and assess the complaint, the Customer is encouraged to provide contact details, the order number, the product concerned, a description of the problem and the requested remedy. Photographs and the batch number may also be helpful. These are not additional conditions for exercising statutory rights. A purchase may be demonstrated by any lawful means and does not require an original paper receipt.

8. The Seller will respond to a Consumer’s complaint within 14 calendar days of receiving it, on paper or another durable medium, such as e-mail. A shorter mandatory deadline will apply where required. Where Polish law applies, failure to respond within the statutory deadline has the consequences specified by that law, including the complaint being deemed accepted.

9. The deadline for responding to a complaint is separate from the time required to complete repair or replacement. Remedies must still be provided within the time and on the conditions required by applicable law.

10. Under Polish law, amounts due following a price reduction are refunded without undue delay and no later than 14 days after receipt of the Consumer’s statement. Following termination due to a lack of conformity, the Consumer returns the Goods at the Seller’s expense and the Seller refunds the price without undue delay and no later than 14 days after receiving the Goods or evidence of their return, whichever occurs first. Any more favourable mandatory rights remain applicable.

11. The Consumer’s statutory rights do not depend on inspecting the parcel in the courier’s presence or obtaining a carrier’s damage report. Prompt notification and photographs may help resolve transport damage, but are not additional conditions for making a statutory complaint.

12. The rights described in this section are independent of any voluntary commercial warranty. These Terms and Conditions do not exclude or limit mandatory consumer rights.

12. Business Customers

1. Consumer protection provisions apply to business Customers to the extent required by mandatory law. This includes, where Polish law applies, certain rights of a natural person concluding a contract directly related to their business where the contract is not of a professional nature for that person, as determined in accordance with applicable law.

2. Business Customers must provide accurate company and tax information required for invoicing and taxation.

3. Intra-Community supplies to business Customers holding a valid EU VAT identification number may be subject to separate VAT rules.

13. Personal data

1. The controller of personal data processed in connection with the operation of the Online Store is VENOL MOTOR OIL Sp. z o.o.

2. Detailed information concerning personal data processing is available in the Privacy Policy:
https://amgoil.eu/privacy-policy/

3. Payment information is also processed by Stripe in accordance with the rules applicable to the payment services it provides.

14. Out-of-court consumer dispute resolution

1. Consumers may use available out-of-court complaint and dispute resolution procedures. Information about recognised alternative dispute resolution bodies is available at:
https://consumer-redress.ec.europa.eu/

2. For disputes involving the Seller in Poland, assistance and dispute resolution may be available through the competent provincial inspector of the Trade Inspection. Information about the Polish system and the register of recognised bodies is available at:
https://polubowne.uokik.gov.pl/

3. Consumers involved in a cross-border dispute within the European Union may seek assistance from the European Consumer Centres Network:
https://www.eccnet.eu/

4. Unless participation is required by law or the Seller has otherwise committed to participate, an alternative dispute resolution procedure involving the Seller requires its agreement.

5. If a dispute is not resolved through the complaint procedure, the Seller will provide the Consumer, on paper or another durable medium, with the information required by applicable law concerning the competent dispute resolution body and whether the Seller agrees to participate.

6. Using or seeking an alternative dispute resolution procedure does not restrict the Consumer’s right to bring a claim before a competent court.

15. Governing law

1. Sales Contracts concluded through the Online Store are governed by Polish law.

2. Where the Customer is a Consumer residing in another country, the choice of Polish law does not deprive the Consumer of protection granted by mandatory provisions of the law of the country in which the Consumer has their habitual residence, where such provisions apply under European Union law.

16. Final provisions

1. The current version of these Terms and Conditions is available at:
https://amgoil.eu/terms-and-conditions/

2. Amendments to these Terms and Conditions do not affect Sales Contracts concluded before the effective date of the amendment unless mandatory law provides otherwise.

3. Matters not covered by these Terms and Conditions are governed by applicable Polish law and European Union law, including mandatory consumer protection legislation.

4. If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions remain in force.

5. This version of these Terms and Conditions is effective from 6 October 2026. Sales Contracts concluded before that date remain subject to the version applicable when they were concluded.
